HB 54   Scavello (PN 25) The Historic Preservation Incentive Grant Act establishes the Historic Preservation Incentive Grant Program within the Department of Community and Economic Development to provide grants to owners of eligible properties located within the state that undertake eligible building improvements. Applications for grants and review and certification by the commission are provided for under the bill. At least 31% of the funds would have to be reserved for eligible residential applicants. If reserved funds are more than are needed to satisfy the total amount of such grants awarded in any year, the department may utilize the excess funds for grants to successful commercial applicants. Priorities can be given to properties located in Elm Street areas, Main Street communities, enterprise zones and in local government historic districts.

HB 179   Miller (PN 122) The Energy Efficiency in State Government Buildings Act provides for a 30 percent reduction in energy use in State buildings by 2015, for energy efficiency and for increased efficiency in the state motor vehicle fleet and for other energy efficiency and procurement. The Interagency Task Force on Energy is established to encourage a diverse supply of energy, promote energy efficiency and conservation, coordinate state agency actions, and identify opportunities for state agencies to lead by example. The bill provides for recognition of efforts to improve State energy efficiency and for annual reporting to the House and Senate Environmental Resources and Energy Committees.

HB 190   Tallman (PN 132) Amends the Public School Code, in education empowerment, further providing for mandate waiver program by adding that a school district receiving a mandate waiver of the provisions of section 751 regarding separation of contracts shall be granted such waiver under the condition that the school district shall solicit bids for the school construction project both as a single-prime contractor construction project and a multiple-prime contractor construction project that complies with the provisions of section 751. The department shall collect and analyze the bids submitted and report its findings regarding the potential costs or savings of mandate waivers of the provisions of section 751 within three years.

HB 193   Harper (PN 3006) The High-Performance, State Buildings Standards Act provides for the creation of high-performance building standards. All building projects or a renovation that is larger than 20,000 gross square feet and at least 90 percent total square feet of a building in facilities owned by a Commonwealth agency shall meet or exceed the prescribed level of achievement under the high-performance building standard outlined in the legislation. The Department of General Services shall promulgate rules and regulations for compliance and shall report annually to the legislature. HB 258   Grove (PN 209) Amends the Public School Code providing for the establishment of a central clearinghouse of prototypical school facility designs for access by school entities. The Department of Education must review and evaluate submitted plans for inclusion in the clearinghouse using certain standards. The bill requires the Legislative Budget and Finance Committee after the fifth year of operation to conduct a study of the department's program to determine the savings incurred by school entities that have participated in the program.

HB 377   Everett (PN 1520) Amends the Pennsylvania Construction Code adding that the act shall not apply to industrialized housing, with the exception that any model code enacted pursuant to the Industrialized Housing Act shall not include code provisions specifically omitted from adoption pursuant to this act. Additionally, the bill states log walls with a minimum average wall thickness of five inches or greater which comply with the International Code Council Standard on the Design and Construction of Log Structures, ICC 400-2007, shall be permitted in residential buildings if they meet certain enumerated standards. Section R501.3 of the 2012 International Residential Code shall be part of the Uniform Construction Code. This subsection shall apply to construction under which the permit applicant opts to not apply the automatic sprinkler requirement. Also provides exceptions for homes built during the interim period of non-applicability and for information to be given to homeowners who opt out. Duties of the Uniform Commercial Code Review and Advisory Council are provided for along with the duties of the department are also provided for. HB 490   Smith, M (PN 445) Amends the Tax Reform Code establishing a green tax roof credit of up to $100,000 in any fiscal year. "Green roof" is defined as an addition to a roof that supports living vegetation and includes a synthetic, high-quality waterproof membrane, drainage layer, soil layer and lightweight medium plants. The credit would be available to individuals and businesses that provide the Department of Revenue with certain required information. A business or individual that has received and taken the credit must repay the credit to the Commonwealth if it fails to maintain the green roof in accordance with the provisions of the commitment agreement.

HB 491   Smith, M (PN 446) Amends the Tax Reform Code establishing the High-Performance Buildings Tax Credit to a taxpayer, whether owner or tenant, for either the construction of a high- performance building or the rehabilitation of a building which is not a high-performance building into a high-performance building. The total tax credit that is available to a taxpayer for a single eligible project shall be distributed in four equal amounts over four years. The amount shall be based on the number of gross square feet of floor space in the eligible building, that building's achievement of an appropriate standard and the tier of achievement earned. In addition, no building may receive a tax credit unless it has earned achievement at or above the Tier I level. All the approved projects shall receive a base tax credit of $35,000 plus an additional tax credit based on a formula outlined in the legislation. The Department of Revenue shall annually report to the House and Senate Environmental Resources and Energy Committees on the credit.

HB 547   Petri (PN 514) Amends the Alternative Fuels Incentive Act providing for state government energy efficiency. The bill calls for a reduction of the Commonwealth's overall use of petroleum-based heating and transportation-based fuels by 15% from the usage levels existing on June 30, 2008, by December 31, 2015. The bill requires the Department of General Services to establish an energy efficiency program for all state buildings, as well as for the state motor vehicle fleet.

HB 571   Benninghoff (PN 548) Amends Titles 53 (Municipalities) & 68 (Real & Personal Property), in miscellaneous provisions, providing for limitations on municipal powers; and, in creation, alteration and termination of planned communities, providing for alterations for energy conservation. In Title 53, the bill states a property owner may not be denied permission to install energy-efficient doors or windows on a building by any local public agency granted the power or right to control or regulate alteration of property with respect to residential dwellings or real property. A local public agency may require that energy-efficient doors and windows meet size and shape design requirements for properties in historic districts. A local public agency is prohibited from denying installation of energy-efficient doors and windows based solely on the materials used in the manufacture of the doors and windows. Title 68 is amended to state a unit owner may install energy-efficient doors or windows in a unit, provided that the doors or windows are aesthetically similar in size and shape to those approved under the declaration or bylaws. Any requirement that doors or windows be aesthetically similar in size and shape shall not limit the materials used in their construction.

SB 61   Greenleaf (PN 46) The Municipal Land Bank and Affordable Housing Act authorizes the governing body of a municipality to adopt an ordinance for or for a question to be submitted to the electorate for, the establishment of a land bank program or an affordable housing program funded through all or a portion of taxes on the transfer of real property. Signatures from 5% of the electors from the last gubernatorial election would be required to bring the question before the electors of the municipality. Money from the Land Bank Fund would be used for the acquisition and maintenance of open-space land and interests in open-space land in the municipality. Two independent appraisals would be required prior to the purchase of the land and all land would be for public purposes. Money from the Affordable Housing Fund would be used for making grants to nonprofit organizations, housing authorities and redevelopment authorities for affordable housing purposes. The governing body of the municipality would be required to give public notice for meetings where a final action on a grant from the Affordable Housing Fund or a final action on an acquisition of open-space land or an interest therein or acceptance of a donation of open-space land is to be taken.

SB 153   Folmer (PN 127) The Energy Efficiency in State Government Buildings Act provides legislative purpose and definitions as well as requires the Department of General Services to establish an energy efficiency target for all state buildings operated by the department. The target shall attain a 20 percent reduction in energy use in all state buildings by December 31, 2013, and a 30 percent reduction in energy use by 2017 compared to that of June 30, 2008. The department shall establish programs in furtherance of this goal and the program requirements are detailed. In the state's vehicle fleet, the department must ensure compliance with the Federal Energy Policy Act of 1992, increase the number of hybrid or alternative fuel vehicles (if capable and cost-effective), increase procurement of bio-based and alternative fuel lubricants, and use diesel and bio-diesel fuel when possible. A review and revision of the commonwealth's energy procurement process and procedures shall be undertaken to ensure energy efficiency in enumerated manners. An interagency task force on energy shall be established, the composition, powers, and duties of which are detailed. An exemption is made for historical buildings.

Of the $100 million for 2010-11, $50 million shall be transferred by DCED to PHFA to create an urban revitalization housing program.

SB 798   Waugh (PN 807) Amends the Public School Code, in grounds and buildings, providing for a prototypical school facility design clearinghouse to be established and maintained by the Department of Education. In order to receive the State reimbursement factor, a school entity must use a prototype design in the construction of school facilities, with exceptions. The Legislative Budget and Finance Committee shall conduct a study of the program to determine the savings incurred by school entities that have participated in the program after the conclusion of the fifth year.

SB 1150   Smucker (PN 1721) The Historic Rehabilitation Investment Incentive Act provides for a tax credit against qualified tax liability in an amount equal to 25 percent of qualified expenditures incurred by a qualified taxpayer pursuant to a qualified rehabilitation plan. Tax credits may not exceed an annual aggregate of $10 million. Credits allowed to any qualified historic structure owner shall not exceed $500,000 in any fiscal year in which tax credits shall be allowed. The geographic distribution shall be taken into account when implementing the $10 million limit. Application process and procedure regarding obtainment of the credits is provided. The Pennsylvania Historical and Museum Commission and Department of Community and Economic Development must jointly approve the tax credit application. Related repeals are made. The Pennsylvania Historical and Museum Commission and Department of Community and Economic Development must jointly approve the tax credit application. The department and commission shall settle on an application fee not to exceed $5,000. Related repeals are made.
